The problem

When you are pursuing debts, particularly large amounts, often you may obtain a credit report. Such a report may show what judgements have passed against the Defender organisation. What the report will not show is what current court actions exist pre-judgement. If you had advanced warning that the Defender organisation were in difficulty this may allow you to take more urgent action such as raising court action immediately thus dispensing with a pre-legal letter. Also you could take advantage of some of our Scottish pre-Decree remedies such as Arrestment, Inhibition or, indeed, proceed with insolvency action. In other words if you had more accurate information you would have more options to choose from. But how can you access this information if its not on public record?

YUILL & KYLE have entered into arrangements whereby we may well be able to establish if a particular debtor is being sued in the Scottish Courts prior to Decree passing, as opposed to once Decree has passed - by which time it may be too late!
